Home sellers should price their homes correctly at the start

I was out showing Real Estate today and one of the houses on the list had been on the market for 644 days!

644 Days!?! That would place this house back to the days when Real Estate was moving at a quicker pace and at pretty good prices.

The Original Asking Price revealed that, indeed, this home had tried to get sold when prices were higher, for the Original Asking Price was $660,000 ... a not-so-far-out-there price for Southern California! :-(

Today, the asking price is $499,000 ... a $161,000 difference!

I remarked to the Buyer who I was with, that this is a problem when Sellers try to get "a little too much" for their homes, at the start. Some Sellers state to me, "Well, I want to try to get more at the start. I can always drop the price if I don't get what I want." But what happens if the market is on the decline?

You will find yourself chasing current market prices, all the way down, as this Home Owner seems to be doing.


For a Seller to price their home correctly, from the very start, is the smartest marketing move around! Stay away from over-inflating your asking price. Stay away from being the highest priced home in your area for your size and condition. Stay away from just trying to grab "that extra dollar" ... you could end up loosing more money, in the long run.

Your Real Estate Agent should be able to help you in this area ... and you should listen to their advice.

By looking at the comps together, you will see how long houses have been up for sale and if they sold at their asking price, over their asking price, or under their price. Listen to the data of the comps and know that most Real Estate Agents aren't out to hurt your pocket book, they are simply trying to do their jobs ... which is get your home SOLD, quickly.  And most will give you sound advice about pricing your home correctly, right from the start!

Capital Gains Tax in 2011: How will it affect you

I've been receiving questions about how the January 2011 Capital Gains tax changes will affect California home sellers and what it may mean if one wants to sell their home in 2011.   When I proposed this question to my personal Tax Accountant, she replied:


There have always been capital gains taxes on the sale of  investment property.  (Currently) Personal residence sales are only taxed if the gain is more  than $500,000 for married filing joint and $250,000 single,  etc.


The 20% hike in 2011 is the proposed amount that capital  gains will be if Obama, Congress and the Senate do not change the law before  12-31-2010. Right now the law is to go into effect 1-1-2011

Proposition 13: keeping Property Taxes low for Californians

While other States can experience drastic rises in the yearly Property Taxes, Californians are lucky to see only a maximum 2% increase in their Property Taxes per year because of Proposition 13. Read below:

Under Proposition 13, the annual real estate tax on a parcel of property is limited to 1% of its assessed value. This "assessed value," may be increased only by a maximum of 2% per year, until and unless the property undergoes a change in ownership. At the time of the change in ownership the low assessed value may be reassessed to full current market value which will produce a new base year value for the property, but future assessments are likewise restricted to the 2% annual maximum increase of the new base year value.

If the property's market value increases rapidly (values of many detached dwellings in California appreciated at annual rates averaging more than 10% in the decade ending in 2005) [6] or if inflation exceeds 2%, [7][8] the differential between the owner's taxes and the taxes a new owner would have to pay can become quite large.

The property may be reassessed under certain conditions other than a change in ownership, such as when additions or new construction occur. The assessed value is also subject to reduction if the market value of the property declines below its assessed value, for example, during a real estate slump. Reductions in property valuation were not provided for in Proposition 13 itself, but were made possible by the passage of Proposition 8 (SCA No. 67) in 1978 which amended Proposition 13. Such a real estate slump and downward reassessments occurred in 2009 when the State Board of Equalization announced an estimated broad scale reduction in property tax base year values due to negative inflation. [9] [10] Property tax in California is an Ad valorem tax meaning that the tax assessed (generally) rises and falls with the value of the property.

Home Sellers slashing prices means it is still a good time to buy Real Estate

Trulia announced this month that 1/4 of every home listed as FOR SALE in the United States have slashed their asking price at least one time, by an average of 10%, with some of the largest cities in the U.S. seeing home prices slashed by 30% or more!

The number of homes FOR SALE is at a higher number than in previous years, and is climbing, due to more FORECLOSURES and SHORT SALES coming on the market, with another wave of Foreclosures on the horizon.

All of this means it is still a good time to purchase Real Estate, with Interest Rates still at historic lows and with sellers asking prices being lowered.


What does all of this mean, if you are a Seller?


Start the sale of your home out right!

Start with the right price to begin with and so beat the competition in getting buyers to write offers on your home.  Ask your REALTOR(R) for a list of recently SOLDS in your immediate area and then price your home 2 or 3% UNDER the lower priced homes on the list ... more if you are desperate and have to sell your home immediately.

Giving buyers incentives ... such as new paint or carpet allowances at the close of escrow ... is another way to make your home stand out from competing homes in your market.

Being prepared for a successful home purchase

Below are some useful tips you should consider when you begin the process of purchasing a home.

1 - If you are thinking of purchasing a home, start thinking about your credit. Don't make any new, large purchases with credit which would cause your debt to income ratio be too large to allow you to borrow for your new home.

2 - Speak to a Lender even before looking for a property. This step is usually over-looked by many buyers who think they know what price range they can afford.  Speaking with a Lender before you start looking, will allow you to look in the correct price range.

3 - Getting "pre-approved" by a Lender is very important in this current market.  Since it is harder to get a Loan these days, sellers and real estate listing agents want to know that you have actually been approved by a Lender to buy the home you are looking at and/or writing an offer on.

4 - If you plan to remain in your new home for any length of time, consider "buying down" your interest rate. Speak to a Lender about what interest rate you can afford.

5 - Listen to your real estate agent's advice about how quickly the market is moving. If it is common that there are multiple offers on most homes being sold, then why write an offer that is below the asking price?  Your real estate agent should provide you with a list of comparables, showing how long properties stayed on the market "for sale" and if they finally "sold" over the asking price.  Such information will help you decide what kind of offer you should write.  Remember, your real estate agent is on your side, and is out to help you purchase the home of your choice.

Living in under 100 square feet of home … Tumbleweed Houses

Want to live in a home which is under 100 square feet? 89 square feet to be exact?

Tumbleweed Houses are just that!

An extremely interesting concept, started by Jay Shafer, who decided to build and live in a tiny home where there would be no waste ... no wasted space, no wasted money on utilities, no wasted money on over-sized mortgage notes!

I applaud the idea ... and the scenery of the mountain location in which one of his homes was situated looks awesome ... but could I live in such a small home? Not if I wanted to keep my husband, I suppose :-)

Tips for the Renter with Bad Credit

With the economy faltering the way it is and with FORECLOSURES and SHORT SALES still on the rise, many people will find themselves looking to RENT yet experiencing difficulty because of their newly acquired BAD CREDIT.

So, what will you do?

Where will you live?

How will you ever get a Landlord to take a chance on you?

Below are some tips that I have seen work for others ... perhaps one of the suggestions will work for you too?



1 - Offer to put "down" more than the asking Deposit. How about offering the Landlord 3 months, or 6 months rent money up front, so that he will know that he has the unit paid for, for those amounts of months.


2 - Offering letters of recommendation from other places / companies where you have been paying consistently on time. This way the Landlord may see that although your mortgage note was too high for you to afford, you still were faithful to pay other bills on time, each month.


3 - Why not offer the Landlord a letter of your history? A time-line of why and when things started going bad for you, and how and why you would be able to afford his rental.


4 - Or find a co-signer for your lease.


If you have been denied the ability to RENT due to Bad Credit, you will be eligible to receive a FREE COPY of your Credit Report from the reporting agencies -- TransUnion, Equifax and Experion. Actually, you are legally allowed to request one report from each agency each year, and by doing so you may be able to help yourself by cleaning up your credit reports if you see any issues that have been resolved and should therefore state such on the Credit Reports.


A private, small owner may be more compassionate about your situation as well, so don't over look the rentals advertised by front yard signs and in your local newspapers.

Prepare Your Home to get it SOLD

What does your home look like through the eyes of a Buyer?

Preparing your home before you put the FOR SALE sign in the ground, by following the below simple suggestions,could mean a quicker sale of your property and more money in your pocket.

Let's look at some suggestions:

Tips for the
Kitchen
-Make kitchens bright, clean, and attractive by painting cabinets and updating cabinet hardware
-Clean ventilating hood
-Clean the stove top and inside the oven
-Put in new flooring if floor is badly worn
-Remove excess appliances (toasters, can openers, blenders, etc) from counters surfaces, to make counters look more spacious
-Make sure the kitchen smells good with candles or potpourri


 
Tips for the
Bathroom
-Repair dripping faucets
-Keep towels fresh and neatly hung
-Clean stains from toilet bowls, bathtubs and sinks
-Keep mirrors spotless
-Keep a deodorizer (such as a "plug-in") in the bathroom
-Replace old, cracking, or discolored caulking around tubs and sinks
-Replace old torn or stained shower curtains

Living Areas

-Fill in cracks and nail holes with Spackle and then freshly paint to match the existing color and sheen
-Newly paint entire walls that are dirty, banged up or worn
-Paint rooms that may currently be too exotic or bold for buyers viewing
-Clean out fireplaces and lay fresh logs
-Wash windows and replace broken windows and/or screens
-Make sure windows and patio doors open easily
-Replace or wash old, tired looking curtains and/or valances

-Clean up oil drips: Most stains can be absorbed by spreading kitty litter over the area for about 24 hours. Then, simply sweep up the litter.

Property tax relief for persons aged 55 and over

What are Propositions 60 and 90?

Propositions 60 and 90 are constitutional amendments passed by California voters that provides property tax relief for persons aged 55 and over. Implemented by section 69.5 of the Revenue and Taxation Code*, it allows these persons, under certain conditions, to transfer a property's factored base year value from an existing residence to a replacement residence.

Typically the property tax of a newly purchased or constructed residence is based on its current market value upon change of ownership. However, the provisions of Propositions 60 and 90 may result in substantial tax savings since it allows the adjusted base year value of the original (sold) property to be transferred to the newly purchased or constructed home if eligibility requirements are met.


What is the difference between Proposition 60 and Proposition 90?

Proposition 60 allows transfers of base year values within the same county (intracounty). Proposition 90 allows transfers from one county to another county in California (intercounty) and it is the discretion of each county to authorize such transfers. As of January 2007, only seven counties have passed an ordinance authorizing intercounty transfers; however, it is recommended that you call your assessor for verification as it could change at any time.


What are the eligibility requirements for Propositions 60/90?

  1. You, or a spouse residing with you, must have been at least 55 years of age when the original property was sold.
  2. The replacement property must be your principal residence and must be eligible for the homeowners' exemption or disabled veterans' exemption.
  3. The replacement property must be of equal or lesser "current market value" than the original property. The "equal or lesser" test is applied to the entire replacement property, even if the owner of the original property purchases only a partial interest in the replacement property. Owners of two qualifying original properties may not combine the values of those properties in order to qualify for a Proposition 60 base-year value transfer to a replacement property of greater value than the more valuable of the two original properties.
  4. The replacement property must be purchased or built within two years (before or after) of the sale of the original property.
  5. To receive retroactive relief from the date of transfer, you must file your claim within three years following the purchase date or new construction completion date of the replacement property.
  6. Your original property must have been eligible for the homeowners' or disabled veterans' exemption either at the time it was sold or within two years of the purchase or construction of the replacement property.
The original property must be subject to reappraisal at its current fair market value at the time of sale, unless the buyer(s) of your original property also qualify the property as a replacement property for a base year value transfer due to disaster relief or a base year value transfer for a severely and permanently disabled person. Therefore, most transfers between parents and children will not qualify.
This is a one-time only benefit. Once you have filed and received this tax relief, neither you nor your spouse who resides with you can ever file again, even upon your spouse's death or if the two of you divorce. The only exception is that if you become disabled after receiving this tax relief for age, you may transfer the base year value a second time because of the disability, which involves a different claim form.

What does "equal or lesser value" of a replacement property mean?

The market value of the replacement property as of the date of purchase must be equal or less than the market value of the original property on the date of sale. The meaning of "equal or lesser value" depends on when you purchase the replacement property. In general, equal or lesser value means:
  • 100% or less of the market value of the original property if a replacement property were purchased or newly constructed before the sale of the original property, or
  • 105% or less of the market value of the original property if a replacement property were purchased or newly constructed within the first year after the sale of the original property, or
  • 110% or less of the market value of the original property if a replacement property were purchased or newly constructed within the second year after the sale of the original property.
In determining whether the "equal or lesser value" test is met, it is important to understand that the market value of a property is not necessarily the same as the sale or purchase price. The assessor will determine the market value of each property. If the market value of your replacement dwelling exceeds the "equal or lesser value" test, no relief is available.


I plan to relocate from Los Angeles County to San Francisco County, but San Francisco County says they don't allow base year value transfers from another county. I thought there was a law that allows that.

The law that allows for transfers of base year value between counties merely authorizes each county board of supervisors to adopt an ordinance accepting transfers from other counties. It is the discretion of each county to allow such transfers. The county in which your replacement property is located must have an ordinance that accepts intercounty transfers.

As of February 15, 2010, the following eight counties in California have an ordinance enabling the intercounty base year value transfer:
Alameda Los Angeles San Diego Santa Clara
El Dorado Orange San Mateo Ventura
Since the counties indicated above are subject to change, we recommend contacting the county to which you wish to move to verify eligibility.


What is meant by "area of reasonable size" as it applies to either the original property or the replacement dwelling?

An "area of reasonable size" that is used as a site for a residence includes all land within the parcel provided that any nonresidential uses of the property are merely incidental to the use of the property as a residential site. For example, if a claimant sold a home located on a 9,000 square foot lot and replaced it with a home located on a 20-acre parcel, the base year value transfer would qualify as long as the 20-acre parcel was used only for a residential site and incidental uses as a residential site. For example, any commercial use (i.e. crops, raising cattle, etc.) would disqualify that portion of the land.


If a replacement home is newly constructed, what is the date of completion?

The date of completion of a newly constructed replacement home shall be the date that the property has been inspected and approved for occupancy by the local building department, or, if there is no such inspection and approval procedure, when the prime contactor has fulfilled all of the contractual obligations. If inspection and approval procedures are non-existent and there is no prime contractor, the date of completion is when outward appearances clearly indicate it is immediately usable for the purpose intended.

The construction on replacement property must be completed within two years of the sale of the original property to qualify for Proposition 60/90/110 tax relief.


How do I file for Proposition 60/90 tax relief?

After both transactions are complete, an application must be filed with the county assessor where the replacement property is located. The claim form, BOE-60-AH, Claim of Person(s) at Least 55 Years of Age for Transfer of Base Year Value to Replacement Dwelling, may be obtained from the assessor's office. Some counties offer a downloadable form from their internet website, which can be accessed via the Board's website: /proptaxes/assessors.htm.


After receiving the notice that my application has been approved for a base year value transfer, will I receive a refund of the taxes I already paid?

Yes, any overpayments you made will be refunded for the period following the effective date of the base year value transfer (i.e., the latest qualifying transaction).

Tips to get your home SOLD

Below are some tips to get your home sold in this declining market:

1 - Price your home fairly at the moment you start to sell your home! 

An over-priced home will not only be over-looked by buyers, but the question will arise later, "Why is that home sitting on the market so long? Is there something wrong with it?" even after you lower your price, if your home does not sell within a reasonable time period.

If you are serious about selling, pricing your home at about 3% (or more) below all comparable home sales (homes that have recently sold or are in escrow) will make sure that buyers don't pass your home up, when deciding which homes to look at.

2 - Make your home stand out from the competition!

Go through my list of TIPS to prepare your home for sale,  to make sure your home is sparkling and ready to "wow" buyers.

3 - Check out your competition

By going through comparable homes with your REALTOR(R), you will be able to see how other sellers have prepared their homes, how they keep up their homes during the selling process, and you can find out what "incentives" they may be offering. Remember, you have to "beat" your competitors, if you want to get your home sold fast.

Home Owners Associations: the pros and cons

Home Owners Associations...or HOA for short.

Some people would never live in a community that did not have a Home Owners Association while others would never consider living under any Associations rules...ever.

Which is right for you?

Before buying any property with a Home Owners Association, it would be good to review what Associations are legally able to enforce. Lets look at some PROS and CONS here to help you decide.

CONS:

When you purchase a property with a Home Owners Association, you give up some rights and agree to live by the rules of the Home Owners Association.

Some rights could be:

-the right to choose what color your home will be painted;
-the right to choose what kind of roof you want on your home;
-the right to choose when you will next paint or re-roof your home;
-the right to choose which plants will be in front of your house;
-the right to choose if you will park in your driveway or in your garage;
-the right to choose if you will leave your garage door open for any length of time, beyond just getting into the garage (its true!);
-the right to let your home go into any state of disrepair ... what is disrepair? any neighbor can complain to the Association what they think is disrepair, leaving the final decision up to the Association;
-the right to rent out your property if you no longer want to live there;
-the right to keep pets;
-the right to even have a dumpster put in front of your home, when you are moving or remodeling unless you pay the Association a fee (as well as the rental fee of the dumpster) and making sure it is removed within the time specified by the Association;
-how about the right to NOT put up Christmas Lights, if you don't want to!
and on and on and on

Failure to live by the Associations Rules can lead to fines and failure to pay your HOA Dues and/or fines can also lead to you having the Association file a LIEN against your home.

Of course not all Associations enforce each of the rules I've mentioned above, (and of course some Associations have rules I have not even mentioned here) but this list is put here to show you what I have personally seen as enforceable RULES from varying Home Owners Associations over the years of selling Real Estate in the Pasadena, La Crescenta, La Canada, Sunland, and now Santa Clarita neighborhoods.

PROS:

"But what about the benefits?" some will ask. These are the people who love living under a set of rules so that they won't have to put up with neighbors who want to paint their houses neon lime green or who park their extra large work trailers on the street every evening, weekend and holiday...never mind the boats, water ski-dos, camper trailers, RVs, and more which can be seen on many Southern California streets, driveways, and even lawns!

The benefits of the Home Owners Association will be just that! The Rules will keep your street and neighbors in line. They will keep your front lawns looking good, and keep the paint from peeling on any single home in the Association.

And if a neighbor steps out of line ... wham-o ... a fine will be slapped on them.

How about a $100 per day fine? Is that fair? Would you want that thrown at you if you stepped out of line, knowingly or unknowingly? Would you like that threat constantly hanging over your head, all the years that you lived in your newly purchased "dream home"? (See here about the $100/day fine for wrong colored mulch.)

Of course the choice is yours to make, but make sure you are informed before you close Escrow on your new purchase. HOA documents are very SLOW at making their appearance during the Escrow, I have found, so do some homework on your own while waiting for the Documents...knock on neighbors doors in the community in which you want to purchase or stop to talk with anyone out watering their lawns or walking their dogs, ask how intrusive the HOA rules are, and then READ YOUR HOA DOCS which will be provided (at some point) during your Escrow!

You just may find that you may not want to live under their heavy-handed rules.
